Despite their diversity, human languages share consistent properties and regularities. Wherefrom does this consistency arise? And does it tell us something about the problem that all languages need to solve? The authors provide an intriguing analyses which focuses on the “communicative function of ambiguity” whose resolution entailed an equally intriguing “speaker–listener cross‐entropy objective for measuring the efficiency of linguistic systems from first principles of efficient language use.”.

In this issue, contributors engage Timothy Murphy’s proposal for irreligious bioethics over against religious bioethics. Two essays take opposing sides in the debate, while a third seeks middle ground. Another essay questions the meaning of the words “religion,” “irreligion,” and “secular.” The final essay examines the religious nature of human existence and its implications for the debate.

What happens when there is not enough data to train machine learning algorithms? In recent years, so-called ‘synthetic data’ have been increasingly used to add to or supplement the training regimes of various machine learning algorithms. Seeking to read the notion of supplementarity differently through an engagement with the work of Jacques Derrida, I propose that the nascent emergence of synthetic data embodies what I call the logic of the synthetic supplement in algorithmic societies. I argue, on the one hand, (...) that the synthetic supplement promises and claims to resolve the ethico-political tensions, frictions, and intractabilities of machine learning. On the other hand, it always falls short of these promises because it necessarily intervenes in that which it claims to merely augment. Ultimately, this means that the gaps and frictions of machine learning cannot be completely filled, supplemented, or resolved. (shrink)

Taking a cue from Teilhard de Chardin's Christologically inflected speculation, the key question in this issue is whether the project of transhumanism is compatible with Christianity and the Incarnation of Christ. Two articles focus on theological anthropology and the limits, if any, of human perfection in light of Christ's perfection. Another article examines the ontological claims about human nature in transhumanism and its incompatibility with a Christian ontology. With the godlike powers of modern technology, just one bad actor can unleash hell on Earth. In the face of this threat posed by technology, some have proposed moral bioenhancement as a solution. Although moral bioenhancement may at first seem like something Christian should support, it is my contention in this paper that there is at least one significant reason for Christians to be cautious in their appropriation of moral bioenhancement technology: it can at best give us a false apatheia, (...) which runs the ironic risk of destroying our ability to make moral progress. In their recent article, Brummett and Muaygil reject Bishop et al.’s framing of the debate over standardization in clinical ethics consultation (CEC) “as one between pro-credentialing procedural and anti-credentialing phenomenological,” claiming that this framing “amounts to a false dichotomy between two extreme approaches to CEC.” Instead of accepting proceduralism and phenomenology as a binary, Brummett and Muaygil propose that these two views should be seen as the extreme ends of a spectrum upon which CEC should be done. However, as evidenced (...) by several inconsistencies within their article, they have failed to fully appreciate the concern animating Bishop et al.’s proposal. Additionally, because of this failure, they do not seem to realize that credentialing ethicists for CEC will only create different problems in Saudi Arabia even as it possibly solves some of the current problems they identify. In this commentary, we highlight and clarify Brummet and Muaygil’s five misunderstandings of Bishop et al. This leads us to conclude that while they claim to be advocating a middle way between proceduralism and phenomenology, in fact they would like for us to standardize another proceduralism, albeit one that incorporates some of the “qualitative” values of American bioethics. Critiques of transhumanism from Christian theologians and philosophers often focus on the movement’s disdain for the human body. These criticisms are expressed in a number of different ways. Some argue that the transhumanists’ disdain is a new form of Gnosticism, while others argue that it leads to real violence against real human bodies. When such criticisms turn to identify the particular sin of which transhumanism is guilty, they sometimes identify vainglory as the besetting sin, but more often than not pride (...) is the sin named. After all, what is transhumanism – with its various proposals for bringing about the posthuman, which is some future being with capabilities so far beyond the human so as to border on godlike – but the latest iteration of the primal sin of humans wanting to become God on their own terms? -/- While such criticisms are valid, they do not capture the depth of transhumanism’s offense from a Christian perspective. Pride and vanity are indeed two of the deadly sins of transhumanism, but there are others at play as well. Moreover, pride is the root of all sin, so saying that pride is the problem is not necessarily helpful. We must find the particular ways in which pride manifests itself. I will argue that the sin of acedia (sometimes spelled accidie), found in ancient lists of the deadly sins, is a primary sin of transhumanism. In so doing, I hope to contribute to a more complete diagnosis of the transhumanist project from a Christian perspective, and I hope to further show why transhumanism is at odds with Christianity, contra the claims of the Christian Transhumanist Association. It should also be stated up front that this article may raise more questions than it answers. Accordingly, it should be seen as an invitation for further research, not as a definitive assessment of acedia in transhumanism. (shrink)

What is the relationship between ideas of sameness and difference for machine learning and AI? Algorithms are often understood to participate in the continual displacement of the different and heterogeneous in society in favour of sameness, of that which is socio-politically similar and proximate. In contrast to this prevalent emphasis on sameness, however, this paper argues that there is a nascent heterophilic logic underpinning the intersection of synthetic data and machine learning, a move towards actively generating differences and heterogeneous data (...) attributes to train, fine-tune, and optimize algorithms. Yet, these synthetic attribute data are nonetheless always machine compatible, devoid of their socio-cultural dynamics and tensions. As such, through a critical examination of three core dimensions of this emergent politics of difference of synthetic data – disentanglement, compositionality, and normativity – the paper argues that this has the potential to ultimately undercut a politics of intervention that seeks to foreground the systemic unfairness and violence of machine learning. Recently, Congress has focused on reforms to address pharmacy benefit managers’ (PBMs) role in high drug prices for patients. Congress must not excessively restrict PBMs’ ability to negotiate with manufacturers; alternatively, reforms could be paired with other policies that address the high prices of brand-name drugs.

This dissertation explains and defends Hegel's "dialectical" logic and the useful critical and normative contributions it can make to philosophy and some aspects of life. Hegel's logic investigates metaphysical "logical" determinations which constitute the structural principles of everything generally, but his context-neutral conception of logical structures and his non arbitrary method sets him favorably apart from other philosophies. It dispenses with the issue whether metaphysics illegitimately projects the mental onto a pre-given world of experience, since even distinctions like "mind versus (...) matter" presuppose prior logical structures. These structures underly other philosophical programs, so Hegel's logic can play an explanatory and critical role against alternatives. Moreover, Hegel's logic neither presents insuperable methodological problems nor suggests absurd conclusions about topics like the law of noncontradiction. ;In Chapter Three I explain and develop Hegel's theory of truth as the correspondence of something's developed, actual existence to its own structural nature. Human thinking and activities especially exemplify truth, since humans have the ability to make themselves and their activities correspond most closely to what they ought to be. In his logic Hegel then provides a normative logical model for becoming a "true" human being: an intrapsychically integrated, normatively committed and free agent engaged constructively with one's social world. ;In Chapter Four I argue that speculative logic can solve and remain invulnerable to longstanding problems in traditional skepticism, especially the more powerful ancient type. Skepticism is effective because its arguments against philosophical claims are implicitly structured according to underlying logical determinations of the types Hegel describes. Skeptical conundrums correspond to the local opposition between the first two moments of dialectical triads, but I show that these moments are only two unintegrated halves of a superior logical structure. In this way, Hegel's logic is able to explain and beat skepticism on a deeper level. (shrink)

This paper explores some issues which a humanlike story system ought to encompass, but which are usually not in the main focus of narrative models since Propp. We argue that knowledge about actions and interactions can account not only for how stories are constructed, but also for why some stories are more interesting and enduring than others. We analyze a traditional English folktale in these terms, and show how classes of surface expressions make recoverable the underlying structures and dependencies that (...) schema‐based understanders comprise. This paper argues that it is prudentially wise to defer to groups about how they are essentially constituted and defined. After a few words situating the paper in my greater research project (§1), I articulate the kind of deference I have in mind (§2). Then I offer two conditional arguments on why it is epistemically desirable to let other people tell you how they ought to be identified (§3). The first argument is that people are owed lexical sovereignty because denying (...) it is absurd; the second is that modest skeptics ought to agree with it on the basis of some relatively anodyne and plausible epistemic considerations. What follows is an attempt to do some conceptual housekeeping around the notion of secret law as provided by Christopher Kutz (2013). First I consider low-salience (or merely obscure) law, suggesting that it fails to capture the legal and moral facts that are at stake in the case which Kutz used to motivate it. Then I outline a theoretical contrast between mere obscurity and secrecy, in contrast to the 'neutral' account of secrecy provided by Sissela Bok (1989). The upshot of (...) the two sections is that low-salience law is neither secret law nor necessarily problematic, though it closely resembles a kind of law that is both secret and problematic: namely, those legal obscurities that subvert manifest interests related to the informational needs of citizens. I shall argue that you can substantially refute the most persuasive variety of solipsism by taking its most plausible version seriously, and then showing that it is not rational to hold, once one understands the nature of actualist metaphysical commitments.1 In the first section, I argue that the only viable form of solipsism involves de dicto self-reference. In the second, I argue that this position involves a claim of contingent identity, for which some actual worlds are those where solipsism is (...) not the case. The argument turns on a conception of metaphysics that involves the study of the universal features of actually possible worlds (i.e., realistic necessity). _*Draft. There at least three ways of thinking about rationality: instrumental, substantive, and intentional. By far, the instrumental account is most influential. This essay proposes that intentional rationality can provide substantive accounts with room to breathe, and in a way that is facially distinct from instrumental accounts. I suggest that the intentionality of a judgment is made up of what it is about and the orientation through which it is judged, while irrationality is the subversion of a strict supporting connection between (...) the judgment and its corresponding set of coordinated attitudes (reasons). It follows that irrational intentionality is made up of episodic states where a judgment is subverted because of a misalignment between what it is about and the way the judge is oriented towards its contents. Four examples of irrational intentionality are considered: passivity towards ends, constitutive ignorance towards facts, delirious paranoia towards objects, and a disjunctive orientation towards categorizations. This paper explores the possibility that Hobbesian jurisprudence is best understood as a ‘third way’ in legal theory, irreducible to classical natural law or legal positivism. I sketch two potential ‘third theories’ of law -- legal pragmatism and legal dualism -- and argue that, when considered in its broadest sense, Leviathan is best viewed as an example of legal pragmatism. I consider whether this legal pragmatist interpretation can be sustained in the examination of Leviathan’s treatment of civil law, and argue (...) that the pragmatic interpretation can only be successful if we can resolve two textual issues in that chapter. First, while Hobbes argues that law entails the existence of public (sharable) reasons, he does not adequately defend the view that the sovereign is the unique authority over such reasons in all cases, especially as far as they concern known collective emergencies. Second, Hobbes both affirms and denies that a sovereign can fail to do justice, which is paradoxical. Both problems are best resolved by legal pragmatism, though the second problem resists a fully satisfying resolution. The upshot is that, although Leviathan ought to be regarded as an episode of legal pragmatism, there are trade-offs on every reading. (shrink)

In this paper, I outline a theory of social kinds. A general theory of social kinds has to set out at least three conditions: existence conditions, persistence conditions, and identity conditions. For the sake of expediency, I focus on the existence and persistence conditions. The paper is organized just as life: first with existence, then persistence. I argue that anti-realism is more attractive than realism as an account of the existence conditions, despite the fact that realism has been under-appreciated. Then (...) I argue for a particular theory of the persistence conditions, which I call the basic overlapping traits theory (BOTT), based on an analogy to an approach to personal identity. The upshot of the argument is that from an anti-realist metaphysics we have the capacity to discuss a wider diversity of social phenomena. (shrink)

In this paper I argue that textualism is far less attractive as a theory of written law than some of its modern proponents think. For it is not usually sensible to expect the grammatical meaning of a provision to determine its appropriate legal meaning. Factors that are unrelated to grammar in the identification of law (e.g., legal theory, context) do too much of the work. **Draft -- acknowledgments welcome, but please do not cite.**.

The very idea of promulgation has been given little to no treatment in the philosophy of law. In this exploratory essay, I introduce three possible theories of promulgation: the ‘no-theory theory’ (which treats promulgation as a matter of particular contexts), the ‘conveyance theory’ (which treats promulgation as a function of intellectual good faith interpreters), and ‘agonistic theory’ (which treats promulgation as indistinguishable from propaganda). I suggest that (at least) three kinds of models are consistent with the theories, and can potentially (...) help us understand when law is successfully promulgated in particular legal contexts: the spread model, the chain model, and the memetic model. I end the paper by comparing the two theories with respect to a case study. Throughout I will show that the conveyance and agonistic theories have a serious advantage over the no-theory theory, in that they allow us to comparatively examine the epistemic weaknesses of diverse theories about the grounding of law on the basis of their contents. In this short paper, I outline a non-standard account of what it feels like to have an intuition. According to this account, intuitive contents are ontologically ambiguous. Because intuition alone is liable to persuade us of both motivated inferences and necessary truths, it is not a reliable source of evidence. However, we would not be able to grasp the concept of necessity without intuitions. Hence, I do not think it is any good to ignore or quarantine our intuitions when forming (...) judgments. (shrink)

Even though tacit legal norms are deeply important to our past, present, and future, the very idea of unwritten law has been difficult to pin down, and problematic in a range of ways. Existing discussions of the phenomenon fall short of adequacy on one of several fronts: either they have focused on describing the normative features of one kind of unwritten law, or completely conflated the study of unwritten law with natural law, or else offered examinations of unwritten social rules, (...) focussing on (mere) custom, ethics, and/or etiquette. A particular defect is the fact that unwritten law has not been given a treatment by those working in the tradition of analytical jurisprudence. My thesis introduces a novel means of analyzing and explicating the elusive concept of unwritten legal rules, striving thereby to advance the state-of-the-art. In what follows I argue that unwritten laws are informally publicized rules held on the threat of formal sanction by an appropriate political authority. I argue that a law is informally disseminated just in case the appropriate governing theory of law, known to subjects, provides those subjects with a set of instructions about who to defer to concerning the contents of the law, absent dissemination in official venues. I propose that there are at least five potential kinds of unwritten law routinely recognized in legal studies: operations, implicit constitutions, justice norms, fiat rules, and secret laws. Through careful examination of extant theories of law (Aquinas, Hobbes, Foucault, Marx, Austin, Fuller, Hart, and Dworkin), I argue that there are identifiable structural features of the contents of these theories that make them more or less likely to endorse the legal validity of each kind of unwritten law. Throughout the course of the dissertation, I show how we are able to diagnose the ways in which these structural features of our theories of law differentially support the validity of—and shed important, additional light upon—each potential variety of unwritten law.
